1. Scope of Services & SLA
DataHub provides web hosting, dedicated servers, cloud infrastructure, and IT support services.
- Service Levels: The availability, uptime guarantees, and compensation regarding our services are strictly governed by our Service Level Agreement (SLA). By using our services, you acknowledge that you have read and agree to the SLA.

2. Account Eligibility & Security
- Eligibility: You must be at least 18 years old to register an account or purchase services.
- Security: You are responsible for maintaining the confidentiality of your login credentials (username, password, and SSH keys). DataHub is not liable for any loss or damage arising from your failure to protect your account.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process.
3. Acceptable Use Policy (AUP)
You agree to use our services only for lawful purposes. Your use of our infrastructure is strictly governed by our Acceptable Use Policy (AUP).
- The AUP outlines prohibited activities, including but not limited to: copyright infringement, spamming, malware distribution, and resource abuse.
- A violation of the AUP is considered a material breach of these Terms of Service and may result in immediate suspension or termination of your account.

5. Payments, Renewals & Refunds
- Billing: Services are billed in advance (monthly or annually). Invoices are sent to the email address on file.
- Late Payments: Failure to pay by the due date may result in service suspension. Data may be permanently deleted if payment is not received within 30 days of the due date.
- Refunds: We offer a 30-day money-back guarantee for shared hosting plans. Dedicated servers and licenses are non-refundable once provisioned.
6. Data Backups & Liability
- User Responsibility: While we perform routine system backups for our own disaster recovery, you are solely responsible for maintaining independent backups of your own data.
- Limitation of Liability: To the maximum extent permitted by law, DataHub shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profit, data, or business interruption) resulting from the use or inability to use our services.
7. Termination
- By You: You may cancel your service at any time via your client dashboard.
- By Us: We reserve the right to terminate or suspend access to our services immediately, without prior notice, if you breach these Terms or the associated AUP.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Kathmandu, Nepal.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on our website. Your continued use of the service after such changes constitutes your acceptance of the new Terms.
